DESCRIPCION DE LA ACTIVIDADES A REALIZADAS POR EL                  INVESTIGADOR –TESTIGO:

De manera técnico –científica se desarrollan actividades de tipo de la investigación criminal siguiendo los protocolos correspondientes en el manejo de información y de cadena de custodia.

MARCO JURIDICO:

La ley 906  en su Capítulo VI, “facultades  de  la defensa” articulo 268  “Facultades  delimputado. El imputado o su defensor, durante la investigación, podrán buscar, identificar empíricamente, recoger y embalar los  elementos materiales    probatorios y evidencia física…”; ARTICULO 271. Facultad   de entrevistar. El imputado o su  defensor, podrán entrevistar a personas con el fin de encontrar información útil para la defensa. En esta entrevista se emplearán las técnicas  aconsejadas por la Criminalística. La entrevista se podrá  recoger y  conservar  por escrito,  en  grabación  magnetofónica,  en video o  en cualquier otro medio técnico idóneo.”Desde el punto de vista técnico y científico, la entrevista es definida como una técnica eficaz para obtener datos relevantes y significativos (Delgado et al, 1999). Como herramienta de investigación social, en la cual se encuentra enmarcada la investigación criminal (Michigan State, 2003), es definida como un instrumento que permite obtener información de un individuo, facilita la recolección de información, es extremadamente flexible (Horvath et al, 2003), capaz de adaptarse a cualquier situación, permitiendo la posibilidad de aclarar preguntas, orientar una investigación y resolver las dificultades que pueda encontrar la persona entrevistada (Wicklander, 1992).La Investigación y acusación propia del sistema Penal Acusatorio se soporta en la preservación de las evidencias físicas y los elementos materiales probatorios, razón por la cual se hace necesario otorgar enorme y excelente trascendencia al tema de la “Cadena de Custodia’’. (Manual de cadena de custodia, FGN).
